1031 Property ExchangesToo many people mistakenly make themselves liable to pay capital gains taxes upon the sale of investment property when they plan to purchase a replacement property. They are unaware of the wealth building strategy allowed by Section 1031 of the Internal Revenue Code. In a 1031 exchange, an individual can defer taxes on any business or investment property that they sell. Section 1031 of the Internal Revenue Code provides that no present gain or loss shall be recognized on the exchange of property held for productive use in a trade or business, or for investment. In such an exchange, a property owner trades one or more relinquished properties for one or more replacement properties of "like-kind," while deferring the payment of federal income taxes and some state taxes on the transaction.
